Bedford Minor Basketball Association (BMBA)  Constitution (Rev.2009 08 20)

 

Article 1 - Name

1.1 The name of the organization is " Bedford and District Minor Basketball Association " , hereafter referred to as "The Association" is a member in good standing of Basketball Nova Scotia.

1.2 The Association is registered with the Nova Scotia Registry of Joint Stocks as a Society. Registry ID # 1973276[R1] 

1.3 The Association’s representative colours are "Blue and White" and the authorized nickname is the "BMBA".

1.4 For the purposes of transacting business, the Association may also be known as the BMBA..

Article 2 - Objective

2.1 The Association, operating as a volunteer, not for profit organization, seeks to foster, promote and coordinate amateur basketball, for girls and boys of all ages and ability within established parameters, in the general community of Bedford including the surrounding areas 1. In addition to encouraging fun, fair play, and fundamental skill development, the Association seeks to give young people the opportunity to learn life skills through sport in a peer setting, which can assist them throughout their lives. The Association strives to make playing basketball an enjoyable experience for all individual players, as well as coaches, executive, officials and parents.

2.2 BMBA is a "Fair Play" organization and strives to attain the values established in this nationally recognized program.

Article 3 - Membership

3.1 The membership shall consist of:

  1. All players, female and male, registered to play basketball for the Association in accordance with Basketball Nova Scotia by-laws or specific Association restrictions, and their parents or guardians.
  2. All persons registered as coaches of the Association.
  3. All persons serving on the Association's Executive.

3.2 Members shall receive all rights of participation in association activities as prescribed by the Association until such time as they no longer meet the membership qualifications, fail to provide the appropriate fees, or are deemed to be dismissed due to discipline or other inappropriate activities as prescribed by the Executive.

 

3.3 The record of all active members will be maintained by the registrar.

 

3.4 Membership is normally restricted to players from Bedford and surrounding areas1, however players outside this residential area may be accepted if such registration is not in violation within any Basketball Nova Scotia  (or other Basketball Associations in Nova Scotia) eligibility guidelines or policies and sufficient space exists as not to prohibit entry from players within the geographic area.

 

3.5 The Executive reserves the right to restrict membership, if deemed necessary, due to the number of players registered. Preference shall be given to returning players, and their families, who register during a pre-registration, with new players and the remaining returning players placed on a waiting list if necessary. Registration is dependent on all fees being accounted for relating to the last season played. Requests for late registration shall be referred to the Registrar and may be subject to rejection or late charge fees as prescribed by the Association.

 

Article 4 – Executive

 

4.1 The Executive of the Association shall consist of the following elected members:

  • President - who is responsible for the overall operations of the Association, by ensuring the by-laws are adhered to and that activities are coordinated and offered in line with the Association's guiding principles. S/he shall preside at all meetings and sign all official documents and Will represent the Association at official meetings and act as official spokesperson. Although the executive will provide guidance and decision-making on most matters, it is recognized that in cases of urgency or in minor matters, the President shall have the power to act on behalf of the Association. The President has the authority to create Committees or positions to action specific issues or to create certain policies, procedures or guidelines to be brought forth to the Executive for approval. The President shall be one of the signatories for the Association
  • Past president the former president who shall provide advice & guidance to the Executive
  • Vice-President - who shall act on behalf of the President at various times when the President is unavailable and may oversee specific areas within the Association as directed by the President. The VP shall have signing authority.
  • Vice-President Communications – who shall maintain the website and deal with internal/external correspondence  to the membership, media & the public
  • Vice President Player Support  - who shall oversee and ensure the delivery of development clinics for players and coaches.
  • Vice President Coaches Support who is responsible for recruiting coaches and running the players selection process. Also maintains contact with coaches throughout the season.
  • Vice President Team Support – who shall oversee the inventory control and purchasing/repair of uniforms and equipment for the Association.
  • Treasurer - who shall maintain the financial records of the Association. S/he shall submit financial statements at Executive meetings and provide an annual report of the Association's financial position. The treasurer is also responsible for all banking related activities. S/he must be one of the signing authorities of the Association.
  • Secretary - who shall keep an accurate record of the proceedings at all meetings. S/he shall notify the members of appropriate meetings, and keep an up to date list of the Executive.
  • Registrar - who shall plan the annual registration and keep an accurate account of persons registered in the Association and provide such a list to the President and Basketball Nova Scotia as required.
  • Members At Large - Up to three elected positions who have voting powers, however are not specifically assigned duties but are expected to provide direct support and involvement in the Association's operations. It is recognized and acceptable that a member may occupy more than one position on the Executive, however the member would be entitled to a maximum of one voting right.

4.2 All executive positions are for a term of two years, however it is anticipated that persons will accept such positions with an expectation of offering for a longer term.

 

Article 5 - Powers of the Executive

 

5.1 The Executive is the primary decision-maker for the Association and can prescribe such policies and procedures to provide guidance in the operations of the Association.

 

5.2 The BMBA Board has the right to remove any member of the board, coach or manager for what is deemed in appropriate or objectionable conduct, either morally or financially, by a majority vote of the Board.

 

Article 6 - Other Positions

 

6.1 The President may appoint the following positions annually to allow for the effective operations of the Association, although such positions are not deemed part of the Executive:

  • Gym/Classic Coordinator - through liaison with facility managers, will oversee the scheduling of gyms.
  • Division Coordinators - who are responsible for the coordination and operation of specific divisions. Their duties include coaching recruitment, the organization of teams, scheduling and opening and closing activities.

Article 7 – Meetings

 

7.1 Meetings shall be called by the President with reasonable advance notice, stating the time, place and expected agenda. At least two meetings shall be called annually, generally considered to occur at the beginning and the end of the established playing season..

 

7.2 Special meetings may be called by the President as deemed appropriate to deal with specific business.

 

7.3 The Annual General Meeting of the Association shall be held within sixty (60) days of the end of the basketball season, for the reading of reports and election of officers for the following season. The Executive Board will hold additional meetings throughout the year to administer the affairs of the Association.

 

7.4 A special general meeting may be called by the Executive at any time, providing reasonable notice is given.

 

7.5 A special general meeting shall be called upon written request of 20% of the Association membership.

 

7.6 All matters of policy of the Association shall be decided by the consensus of the Executive. If consensus cannot be agreed upon as determined by the President, a vote shall be held with a simple majority deciding the issue. In the cases of a tie, the President shall have the authority to break the tie.

 

7.7 A majority of the Executive, shall constitute a quorum (i.e 50% + one), and all attending Executive are provided one vote, with no absentee voting allowed.

 

7.8 All General Meetings will be open to the membership, however attendance at Executive meetings would be limited to BMBA Board Members or by invitation.

 

Article 8 - Managers and Coaches

8.1 Managers and Coaches of competitive teams shall be selected and approved by the members of the Executive or may be delegated to the selection committee or Division Coordinators.

 

8.2 Managers and Coaches shall be responsible for their team's conduct, their own conduct and wherever possible the conduct of team supporters. The Association has a proud reputation of exemplary coaching conduct and expects all coaches to act in a responsible and mature manner.

 

8.3 The Managers and Coaches of competitive teams will select their Assistant Coaches, but the selection is subject to review by the Executive, should such a review be warranted.

 

8.4 The Managers and Coaches of competitive teams will select their players, with the selection subject to review by the Executive, only in such rare instance whereby there is an allegation of procedural misconduct or a flagrant disregard for fairness. The Association recognizes that such player selections are often difficult and subject to individual opinion, however supports coaches in this area and will intervene only in situations of serious allegations.

 

Article 9 - Financial Policy

 

9.1 The Executive shall decide all matters pertaining to the finances of the Association as outlined in the annual budget, including the setting of fees.

 

9.2 Funds will be dispersed (i.e. cheque signing authority) on the authority of any 2 of the Treasurer, Registrar, President or Vice President.

 

9.3 The President and Treasurer have discretionary powers of expenditures for emergency situations, however shall report these expenditures as soon as possible to the Executive.

 

9.4 All funds raised shall be used for the purposes of BMBA and the executive shall set fundraising guidelines for all members to follow.

 

9.5 An annual financial statement shall be produced and publicized for all members where practical.

 

9.6 Any audit or review of the documents can be brought forth by motion, however allowing for a reasonable time to produce such records, unless directed by law.

 

Article 10 – Rules

 

10.1 The Eligibility, Tournament and Playing Rules of Basketball Nova Scotia (BNS), as issued each year through the Office of the Executive Director, shall govern the playing of all games in all divisions, sponsored by BNS.  Exhibition games will follow the BNS rules. Tournaments sponsored by BMBA will use the above rules along with their own association rules.

 

 

10.2 The Association reserves the right to modify or alter certain rules for local house league operations through local policies approved and adopted by the Association as long as they do not materially alter the game or be in in material violation of BNS standards.

 

Article 11 - Registration of Association

 

11.1 The Association shall register each year, in accordance with the Basketball Nova Scotia by-laws.

 

11.2 The Association must be a member in good standing with the Nova Scotia Registry of Joint Stocks Companies. The Association must file an annual financial report, as well as an updated list of directors, after each subsequent Annual General Meeting. Information and forms can be obtained online at www.rjsc.ca.[R2] 

 

Article 12- Affiliation

 

12.1 For the purposes of discipline, eligibility, rules, dispute resolution or any issue not specifically covered by this Constitution, the Association may utilize protocols established by Basketball Nova Scotia.

 

Article 13 – Amendments

 

13.1 This Constitution or any section thereof may be amended or repealed by a two-thirds vote of the Executive present at any stipulated meeting, provided, that notice of such proposed change or changes shall be read at a scheduled meeting of the Executive, and that a copy be mailed to Basketball Nova Scotia at least 15 days prior to the meeting at which the proposed change or changes shall be submitted for vote.

 

Article 14- Dissolution

 

14.1 If for any reason, the Association ceases to operate for more than 2 consecutive years, any assets shall be dispersed by the last sitting President of the Association to a registered charity with some relation to child wellness or to Basketball Nova Scotia.

 

1 surrounding  areas of Bedford include Kingswood, Crestview, Hammonds Plains & Pockwock. Any rezoning, changes in boundaries or additions will be subject to interpretation by a majority vote by the BMBA Executive.




Addendum A - Fundraising Policy

Bedford Minor Basketball Association
FUNDRAISING POLICY

Purpose: To set fundraising guidelines for the Bedford Minor Basketball Association to ensure teams and individuals have parameters to follow.

Guidelines: In addition to general fundraising done by the club, it is understood that some teams may wish to fundraise to help defray some of the operational costs of the team. 
The following team expenses can be covered or offset through fundraising:

1. Referees

2. Gym Rentals

3. Tournament Registration Fees

4. Team Travel and Accommodations

5. Socials up to $200.00

Any other expenses are not eligible unless approved by the Executive. Teams that wish to purchase individual team clothing can do so at their own expense but not through club fundraising efforts.

Types of Fundraising: It is anticipated that members and teams of Bedford Minor Basketball Association will use good judgment in the type of fundraising activities they become involved in. The Association does not approve activities that encourage or promote tobacco products or directly promote alcohol. All fundraising activities must be approved by at least 66% of parents of the team doing the fundraising and the Executive must be notified and approve any fundraising events before they proceed.

Distribution of Funds: Monies raised by the team shall be treated as a team fund to be distributed toward the above noted expenses at the discretion of the Manager/Coaches. In the event that there is a surplus of funds at the end of the year,
these funds may be used by the team to purchase clothing or other items for the players. Any unused funds are to be returned to the treasurer at year end.

Sponsorship: All Business Sponsorships shall be done at the League Level only. Team Sponsorships are not permitted. 

Fundraising Limits: Team fundraising will be limited to a maximum of $1,500 per year. This limit can be raised for special circumstances and with the approval of the Executive.

General: All fundraising shall be clearly distinguished as to whether it is for the Bedford Minor Basketball Association or for a designated team of the club. Managers/Coaches must submit a budget prior to the end of the calendar year of the current season and reconcile their budgets no later than 1 month after their Provincial Tournament.

 

Provincials: BMBA will pay for the gyms, referees & scorekeepers from the hosting fees supplied by Basketball NS. Any monies left over will be kept by BMBA. Hosting team(s) must follow the current year Basketball N.S. Provincial Tournament Hosting Guide. Profits raised from the gate, 50/50 draws, canteen etc., will be retained by the hosting team(s).

BMBA will pay for the gyms, referees & scorekeepers , not to exceed the hosting fees supplied by Basketball N.S. f the budget is exceeded, it will be the responsibility of the hosting team

 to cover excess expenses out of the gate receipts. If there are extenuating circumstances, the BMBA Board will decide on what steps should be taken.



Addendum B – Registration & Fee Payment Policy – Update August 2010

 

  • All players who were registered with BMBA for the past season will be sent a registration package by email.  The package will be sent two weeks prior to commencement of on-line registration, as set and published by the Registrar.   
  • A registration notice will also be posted on the website two weeks prior to commencement of on-line registration, as set and published by the Registrar. 
  • It is the responsibility of the parent/guardian of any player who to inform BMBA of the new email address.  Changes should be emailed to the Registrar at bmbaregistrar@eastlink.ca.  On-line Registration will be accepted during a three week period between July 1 and September 30th  as set and published by the Registrar for that given year.
  • All new players must submit, prior to MBA seasons first game, a photocopy of his or her birth certificate, passport or Health card as proof of age, in order to join BMBA.  Proof of age for all players will be kept on file by the Registrar.
  • Families with 4 or more players in BMBA will pay the normal registration fee for the first 3 players, and half price for the remaining family members. 
  •  The maximum enrolment in Tots will be 35 players per session. There will be one session for girls and one for boys.  Additional sessions may be added dependant on coach availability and gym space.   
  •  A full refund (less an admin fee of $30) will be provided to any player withdrawing before the MBA seasons first game.  To be clear, this $30 fee is also applicable to Midget players that withdraw after successfully making a High school team.
  • Only in cases of extenuating circumstances (for example a season ending injury or family relocation) will the board entertain a request for a pro-rated reimbursement of registration fees upon the withdrawl of a player after the MBA seasons first game.  Further, any such reimbursement must be approved by the board by a simple majority vote.  The maximum reimbursement the board may approve under this policy is 80%, less the $30 admin fee.
  • HRM Kids Program:  All players who wish to receive financial assistance for BMBA registration fees must apply through the HRM Kids Program which is run through the LeBrun Centre by the Recreation coordinator.  Financial Assistance will be given to those players who are approved for assistance by HRM Kids. Those applying must notify the Registrar of their application, in order to maintain their priority of registration status (approval from HRM and receipt of payment can take weeks/months to receive.)
  • A $30 fee will be charged by BMBA for all cheques returned as “NSF” (non sufficient funds).
  • Coaches wishing BMBA to purchase additional gym time for their team practices, exhibition games etc., will have to pay the full amount due in advance of the gym rental.
  • PLAYER REGISTRATION PRIORITY  - in the event that there are, in the opinion of the board, insufficient coaches to field the number of teams required to absorb the total number of players registered in a division (max of 11 players per team), the registration for that division shall be reduced accordingly and the surplus players placed upon a waiting list.  Returning players (defined as having played for Bedford in either of the two previous in MBA seasons) shall have precedence over New players.  Within those two categories (Returning and New), priority shall be normally be determined strictly by time of registration, first come, first registered.  However, the board reserves the right to set aside order of registration within the Returning player category to accommodate a player or players based upon the contributions of their parents or guardians to the organization within the past two years in the following roles:  Head Coach, Assistant Coach, Board member, or Bedford Classic Facility Manager. 
  • Further, the Board may also make a similar accommodation to a player (Returning or New) that brings with them a Head Coach for the upcoming season in the event that this would directly enable BMBA to field another team and accommodate other players that would otherwise be on a waiting list.  However, that parent or guardian must coach a team at the gender and level (boys or girls/competitive or rec) agreed to, despite where their child is actually placed through the try-out process.  In the event that the child is placed on a team that the parent or guardian was not slated to coach, and the parent or guardian then reneges on their commitment to coach, the board shall cancel that player’s registration immediately. 

 

  • The $30 admin fee applied to refunds will be of course waived for any player that registers, pays but then cannot be placed on a team due to the Registration Priority policy.


Addendum C – Team Selection & Appeal  Policy

 

The team selection policy shall be established by the Executive and published on the website annually prior to the commencement of the process.

 

 

Addendum D – Code Of Behaviour


FAIR PLAY POLICY

 

Bedford Minor Basketball follows the Fair and Safe Play Program policies and procedures accredited by the Nova Scotia Sport and Recreation Commission.

 

The principals of fair play in sport combine integrity, fairness, and respect. These principals include:

 

-Respect the rules.

-Respect the officials and their decisions.

-Respect your opponent.

-Maintain your self-control at all times.

 

All players will play in a game. Playing time will depend on the teams rules and goals.


 
For Parents/Gaurdians:

1)     
I will remember that children play sport for their enjoyment. They are not playing to entertain me.

2)      I will not have unrealistic expectations. I will remember that child athletes are not miniature professionals and cannot be judged by professional standards.

3)      I will respect the officials’ decisions and I will encourage participants to do the same.

4)      I will never ridicule an athlete for making a mistake during a competition. I will give positive comments that motivate and encourage continued effort.

5)      I will condemn the use of violence in any form and will express my disapproval in an appropriate manner to coaches and league officials.

6)      I will show respect for my team’s opponents, because without them there would be no game.

7)      I will not use bad language, nor will I harass athletes, coaches, officials or other spectators.

 

 

 
For
 Players:

·         Play by the rules

·         Never argue with an official. If you need clarification, have your captain, or coach approach the official during a break.

·         Work equally hard for yourself and your team. Your team’s performances will benefit-so will you.

·         Be a good sport. Show support to your team and to other players.

·         Show respect to and acknowledge opponents and officials (e.g. shake hands, say thanks for the game etc.)

·         Cooperate with your coach, teammates and opponents. Without them, there would be no competition.

·         Participate for your own enjoyment and benefit, not just to please parents and coaches.

·         Play Fair-no verbal abuse of officials, or deliberately distracting or provoking an opponent.

·         Respect the rights, dignity and worth of all participants regardless of their gender, ability, cultural background or religion.

       

AS A COACH:

You want every child's experience in sport to be a positive one. Although you would like to win, emphasis should be placed in the importance of skill development and fun. You believe in the fair play program and that it should be taught to your athletes.

 For Coaches:

*I will remember when scheduling games and practices, that young athletes have other interests and obligations.

*I will teach my athletes to play fairly and to respect the rules, officials and opponents.

*I will ensure that all athletes are provided with equal instruction and support.

*I will not ridicule or yell at my athletes for making mistakes or performing poorly.

*I will remember that children play to have fun and must be encouraged to help boost their confidence levels.

*I will make sure that equipment and facilities are safe and match the athletes' ages and abilities.

*I will remember that children need a coach they can respect. I will be generous with praise and set a positive example.

*I will obtain proper training and continue to upgrade my coaching skills and abilities.

*All players will play in every game. Players not following the Associations or Team rules could be suspended from play. This action must be discussed with the player, parent and MBA VP Coaches Support.

* I will adhere to and follow the player discipline policy.


For Parents :

 

·         ensuring players attend practices and games - on time

·         support team rules and regulations

·         support the team and the coaches decisions

·         be a positive spectator and encourage and congratulate players for their effort and skill

·         have positive discussions with children about their play, and the teams play.
